These Terms of Use ("Terms") govern access to and use of the Constance app ("the Service"), an AI-assisted sports and nutrition coaching application. By creating an account, you fully accept these Terms as well as our privacy policy.
Constance generates a personalized sports and nutrition program from the information you provide (profile, goals, available equipment), tracks your daily meals, sessions and deviations, and offers an "anti-drop-off" support that adapts the program to your real situation. Some features (calorie estimation, session generation, coaching messages, meal suggestions) are produced by a third-party artificial intelligence model (Google Gemini) and are estimates, not exact measurements.
Constance is not a medical device and does not replace the advice of a healthcare professional. Sports and nutrition recommendations are generic and adapted to self-declared information; they do not take into account specific conditions, injuries or medical treatments. Consult a doctor before starting an exercise program, especially if you have any doubt about your health.
You agree to use the Service in accordance with its intended purpose and not to:
Any breach found may result in the suspension or deletion of the account, without prejudice to possible legal action.
The Community tab lets you share certain activities (sessions, meals) and photos with other users, according to the privacy level you choose yourself ("World", "Friends" or "Private"). You remain solely responsible for the content you choose to share. You can at any time remove a post, block another user (which cuts off all mutual relationships and access), or fully disable sharing from the privacy settings.
Zero tolerance for objectionable content and abusive behaviour. Every post, comment and profile can be reported directly from the app (the "Report" button). Constance reviews reports and removes content that breaches these Terms, usually within 24 hours, and may suspend or delete the accounts of the users responsible. By posting in the Community you agree to these rules and agree not to share any content that is illegal, abusive, harassing, discriminatory, sexually explicit or that infringes the rights of others.
The Premium plan — like the former "Max engagé" and "Max flexible" plans — gives access to messaging with a human coach. Messages exchanged in this context are read by the assigned coach for the sole purpose of answering your coaching questions; they are neither public nor shared with other users.
The referral program lets you earn points convertible into a PayPal payout when the referred person completes the first payment of a paid plan (their first monthly or yearly instalment, where applicable at the end of their free trial). A sign-up or free trial without a payment does not earn any points. The payout conditions (threshold, scale per plan) are shown in the app and may change; points already earned remain valid at the scale in force at the time they were awarded.
The app, its design, its editorial content and its brand remain the exclusive property of Constance. No reproduction, extraction or reuse is permitted without prior agreement, except for the content you publish yourself (your meals, sessions, shared photos), which you retain ownership of and which you authorize us to display in the app as part of its normal operation (community feed, photo comparison, etc.).
Constance uses reasonable means to ensure the availability and reliability of the Service, without any guarantee of results. Constance cannot be held liable for:
You can delete your account at any time from the Account page (danger zone), which results in the permanent and irreversible deletion of all your associated data, subject to legal retention obligations (in particular accounting, in the event of payment). Constance may suspend or terminate an account in the event of a serious or repeated breach of these Terms, after attempting to notify you beforehand where possible.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content or a service fully performed before the end of the withdrawal period, with your express agreement and explicit waiver of that right. By subscribing to a paid plan and immediately accessing the generated program, you acknowledge waiving your right of withdrawal for this service. You retain in all cases the ability to cancel your subscription at any time under the conditions of Article 3.
Constance may modify these Terms at any time, in particular to reflect changes to the Service or to regulations. Any material change will be brought to your attention via the app before it takes effect. Continuing to use the Service after notification constitutes acceptance of the modified Terms.
These Terms are governed by French law. In the event of a dispute, and in accordance with the provisions of the French Consumer Code relating to the amicable settlement of disputes, you may, free of charge, refer the matter to a consumer mediator before any legal action. Failing an amicable resolution, the competent French courts shall have sole jurisdiction, without prejudice to the mandatory consumer-protection provisions of your country of residence within the European Union.
